WHSsports.net and RadioTime exercises no editorial or programming control ("Third Party Content"). You understand that (a) WHSsports. and RadioTime does not guarantee the access to, recording, or viewing of any particular program, (b) programming is not under WHSsports.net or RadioTime's control, (c) radio broadcaster may make program line-upchanges too quickly for RadioTime to adjust recording times and this means shows affected by such changes will not be recorded properly or at all, (c) WHSsports.net and /or  RadioTime is not responsible for and
has no editorial control over any Third Party Content, and (d)
Whssports.net and RadioTime has no control over the distribution of
programs. You agree that WHSports.net and RadioTime will have no
liability to you, or anyone else with regard linking to any Third Party Content.

Indemnity - YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS WHSsports.net HSPN Media, LLC, HSPN360.com, and  RadioTime, THIRD PARTY STATIONS FROM AND AGAINST ANY AND ALL CLAIMS, PROCEEDINGS, INJURIES, LIABILITIES, LOSSES, COSTS AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES), INCLUDING, BUT NOT LIMITED TO, CLAIMS ALLEGING NEGLIGENCE, THIRD PART LINKING, COPYRIGHT INFRINGEMENT AND/OR TRADEMARK INFRINGEMENT,  AGAINST WRHSsports.net, HSPN Media, HSPN360.com, Third party stations, and RadioTime OR THE RadioTime SERVICE, RELATING TO OR ARISING OUT OF YOUR BREACH OF ANY TERM OF THIS AGREEMENT, YOUR MISUSE OF THE WEBSITES THAT PROVIDE LINKING AND SERVICES. 

By reviewing this notice WHSsports.net, HSPN Media, LLC, HSPN360.com, and Third Party Stations of RadioTime cannot be held liable for any infringement by the author of that website; (2) linking cannot constitute direct infringement because the computer server of the linking web-site does not copy or otherwise process the content of the linked-to site; and (3) multiple liking cannot constitute contributory infringement because (a) Internet users viewing of the material at issue is not infringing and thus there was no direct infringement in the United States to which [the defendant] could contribute, (b) linking 'is capable of substantial no-infringing uses' and thus cannot support a claim for contributory infringement.
